1. Purpose: Senator Broadman maintains social media accounts and pages primarily as a way to communicate to Oregonians through multiple online channels, as a supplement to official communications with Oregonians through email, meetings, and traditional media sources. Senator Broadman welcomes input from the public on social media, but he does not have the capacity or ability to monitor and moderate his social media on a full-time basis. Though social media is a useful way to reach many residents, Senator Broadman does not believe that social media is necessarily the best forum for nuanced or difficult discussions about state business and issues. The best and most effective way of making a comment, giving input, or otherwise connecting with Senator Broadman is by sending an email to sen.anthonybroadman@oregonlegislature.gov.
2. Personal opinion: Broadman’s social media sites are maintained by Senator Broadman, are not official pages for the State of Oregon, and do not represent the official position of government or official. Any opinions or thoughts expressed by Senator Broadman on social media are his own personal opinions or thoughts unless otherwise stated.
3. Comment policy: All content submitted by the public on Senator Broadman’s social media sites is monitored and moderated, and is considered public information that may be subject to disclosure to third parties under Oregon Public Records law. Senator Broadman maintains the discretion to hide or remove comments that:

    • Violate the terms of use of the social media site where the comment is posted;
    • Include threats or harassing personal attacks;
    • Promote, foster, or perpetuate discrimination upon the basis on race, religion, gender, gender identity, marital status, familial status, national origin, age, mental or physical disability, sexual orientation, source of income, or other protected status under applicable law;
    • Conduct or encourage illegal activity;
    • Infringe on copyrights or trademarks;
    • Include solicitations of commerce or charitable contributions, except for City-sponsored activities;
    • Include inappropriate content or links to inappropriate content;
    • Include repetitive, “spam” comments or comments unrelated to the topic at hand;
    • Include private and confidential information; and
    • Include information that may tend to compromise the safety or security of the public or public systems.

If these are repeated violations of this policy or the social media site’s terms of use by certain individuals or entities, Senator Broadman may take steps to exclude comments and posts from those individuals or entities.

Responsibility: Please note that the comments expressed on Senator Broadman’s social media pages by individuals do not reflect the opinions and positions of Senator Broadman or the State of Oregon. Senator Broadman takes no responsibility and assumes no liability for content posted by individuals on his social media pages.

5. Lindke v. Freed Statement:  In summary, the social media accounts @broadmanfororegon and @thebroadman and @anthonybroadman are the personal accounts of Senator Broadman and the views expressed therein are strictly his and his personal staff’s own.  To the extent a post appears compatible with either a “personal capacity” or “official capacity” designation it is “personal” because it appears on Senator Broadman’s personal social media accounts.  When a government official posts about office-related topics on social media, it can be difficult to tell whether the speech is official or private. Senator Broadman’s posts on social media accounts are not attributable to any government body because he is not exercising or purporting to exercise actual authority to speak on any government body’s behalf on social media.  Some of the statements on Senator Broadman’s personal social media accounts are “relate[d] to his public employment” or “concern[ing] information learned during that employment.” Lane, 573 U. S., at 238. That does not alter the fact that such posts are personal.
